The short version
- These terms are an agreement between you and Sable Servers Ltd., a Nova Scotia company.
- The price you sign up at is the price you keep, as long as the service stays active on the same plan and billing cycle.
- Services renew automatically until you cancel. You can cancel any time in the panel.
- You own your content. Keep your own backups of anything important.
- We don’t promise an uptime percentage. We do tell you about maintenance and problems on our status page.
- Follow our Acceptable Use Policy. Serious abuse ends your service.
- Nova Scotia law applies, but you keep any rights your own consumer protection law gives you.
This summary isn’t the full agreement. The sections below are.
1. Agreement and who we are
These Terms of Service (“terms”) are an agreement between you and Sable Servers Ltd. (“Sable Servers”, “we”, “us”), a company incorporated in Nova Scotia, Canada. “You” means the person or organization that holds the account. If you accept these terms for an organization, you confirm you have authority to bind it.
These terms cover our websites (sableservers.ca, and sableservers.com for US visitors), our Unified Panel and store at unified.sableservers.com, and every service we provide. Our Acceptable Use Policy and Privacy Policy form part of this agreement.
You accept these terms when you create an account, place an order or use a service. If you don’t agree, don’t use the services.
2. Accounts and eligibility
Who can sign up
You must be 18 or older, or the age of majority where you live if that is higher. Someone younger may use the services only if a parent or guardian agrees to these terms and takes responsibility for the account. Children under 13 may not use the services.
Accurate information
Give us accurate details when you sign up and keep them current, especially your email address. We send important notices there. One account covers everything; don’t open extra accounts to get around limits or promotions.
Account security
You are responsible for your login details and for what happens under your account. Use a strong, unique password. We encourage you to turn on two-factor authentication in the panel. Tell us right away if you think someone has accessed your account without permission.
3. The services
Each service works as described on its product page and in your order at the time you buy it. Our main services are:
- Game servers for Minecraft, Rust, ARK, Palworld and other games, plus custom builds. Player and slot limits depend on the plan.
- Cloud Compute (VPS, KVM), including Linux VPS with full root access, Windows VPS and HomeLab VPS.
- Web hosting with free Let’s Encrypt SSL, email, staging and backups on the schedule your plan includes.
- Object storage: S3-compatible buckets in our CA-East region in Toronto, run on Backblaze B2 infrastructure.
- Managed servers: Semi-Managed and Fully Managed, per server, billed monthly.
- Business services: managed IT, IT consulting, website design and custom business applications.
We run services in Halifax (HFX1) and Montreal (YUL1). Firewall-based DDoS protection is included.
Windows Server licensing
Windows Server VPS plans are Bring Your Own License. You must supply a valid Windows Server licence that permits use on third-party hosted infrastructure, and keep it in compliance for as long as you run Windows on our servers. To help confirm compliance, we may run read-only checks of a Windows server’s licence and activation status. These checks don’t access or change your files or data. Services found running without a valid licence may be suspended after notice.
HomeLab VPS
A HomeLab VPS has no public IPv4 address. You reach it over WireGuard. It isn’t suited to hosting anything that needs to be reachable from the public internet.
Quoted business services
Managed IT, networks and on-site work, website design and custom applications are provided under a signed quote or proposal. That document, including any terms attached to it, sets the scope, price, schedule and response times. These terms apply alongside it. If they conflict, the signed quote wins for that service.
Changes to services
We may improve or change a service. If a change materially reduces what you paid for, we’ll give you at least 30 days’ notice, and you may cancel and get a prorated refund for the unused part of your prepaid term. Changes needed for security or to comply with the law may happen sooner.
4. Orders, billing and price lock
Orders and billing cycles
You order services through the store at unified.sableservers.com. Services are billed in advance, monthly, quarterly, semi-annually or yearly, as you choose. Longer cycles cost less.
Currency
Prices are in Canadian dollars and we always bill in CAD. Any US dollar price on our websites is an approximate conversion for convenience. If your card is not in CAD, your bank may charge its own exchange rate and fees.
Automatic renewal
Services renew automatically at the end of each billing cycle until you cancel. We issue the renewal invoice before the due date. If you have a card on file, you authorize us to charge it for each renewal.
Price lock
The price you sign up at is the price you keep. An active service keeps its price for as long as it stays active on the same plan and billing cycle, even if our list prices go up. The price lock ends if:
- you cancel the service;
- the service is terminated for non-payment; or
- you change the service to another plan or billing cycle. The new plan is billed at its price at the time of the change.
Promotional and first-term discounts end when the promotion says they end. After that, the locked price is the regular price of your plan at the time you signed up.
Taxes
Sable Servers Ltd. is not currently registered to collect GST/HST. Our prices include no sales tax and we don’t charge any. If that changes, we’ll tell you before we start adding the tax the law requires.
How you can pay
- Credit or debit card, processed by Stripe.
- Interac e-Transfer to billing@sableservers.com.
- Account credit.
Late payment
If an invoice is still unpaid 3 days after its due date, we suspend the service. If it is still unpaid 7 days after suspension, we terminate the service and may delete its data (see section 9). Paying the invoice while the service is suspended restores it.
Effective November 6, 2026, the non-payment deletion period changes from 14 to 7 days after suspension. Invoices due before November 6, 2026 stay on the 14-day rule.
Chargebacks
If you think a charge is wrong, contact us first at billing@sableservers.com. We fix billing mistakes quickly. If you dispute a charge with your bank instead, we may suspend the account while the dispute is resolved.
Loyalty credit
After 12 consecutive months of service, you earn a free month of hosting. We track this automatically and apply it to your account. It has no cash value and can’t be transferred.
5. Cancellations and refunds
Cancelling
You can cancel any service at any time in the panel. Choose either:
- End of billing period: the service runs until the paid period ends and does not renew.
- Immediately: the service stops now and its data is deleted (see section 9).
Refunds
Cancel a new service within 30 days of activation and we refund the unused part of the term, prorated. After 30 days there are no refunds for the current term; cancelling stops future renewals.
Setup fees, domain registrations, licence fees and one-time services are not refundable. Services terminated for breaking the Acceptable Use Policy are not refunded. Refunds go to the original payment method or to account credit, as you choose. Refunds for quoted business services follow the signed quote. None of this limits a refund your local consumer protection law entitles you to.
6. Acceptable use
Your use of the services must follow our Acceptable Use Policy, which forms part of these terms. You are responsible for everything that runs on or passes through your services, including what your users, players and customers do.
We may investigate suspected breaches, and may suspend or terminate a service as set out in section 9. Child sexual abuse material gets zero tolerance: we terminate immediately, without refund, and report it to Cybertip.ca and the RCMP (and to NCMEC where relevant).
Copyright complaints
We follow Canada’s Notice and Notice regime under the Copyright Act. We forward valid notices to the customer concerned and keep records as the law requires. Complainants in the US can send a DMCA-style notice to abuse@sableservers.com. The Acceptable Use Policy explains what a notice must include.
7. Your content and data
You own it
You keep all rights to the files, data, websites, game worlds and other content you put on our services. You give us only the limited licence we need to host, store, copy, transmit and back up that content to run the services for you. That licence ends when your content is deleted.
Backups are your responsibility
Web hosting plans include backups at no charge. For game servers and virtual servers, backups are a paid add-on. Either way, backups run on the schedule described on the plan or add-on. They are a convenience, not a guarantee. Keep your own copies of anything you can’t afford to lose, stored somewhere other than the same service.
Where your data lives
Customer data on our services is stored in Canada, in Halifax or Montreal, or in Toronto for object storage. Some providers we use for payments, email and advertising measurement, such as Stripe, Microsoft and Meta, may process account and billing information in the United States or elsewhere. The Privacy Policy explains how we handle personal information.
When we access your services
Our staff don’t look at your content unless we need to: to give support you ask for, to deliver a managed service, to investigate abuse or a security threat, or because the law requires it.
8. Service levels
We build and run our services carefully, but we don’t guarantee an uptime percentage. Hardware fails and networks have problems. When something goes wrong, we work to fix it and keep you informed.
We post planned maintenance on our status page in advance and tell affected customers by email. Urgent security or stability work may happen with short or no notice.
If an outage hits you hard, contact us. We may give service credits at our discretion. Credits are account credit, not cash. Response times for managed IT plans are set by your plan or signed quote.
9. Suspension and termination
By you
You can cancel any service in the panel, or close your account by opening a support ticket. You still owe anything already due.
By us
We may suspend or terminate a service, or your account, if:
- you don’t pay on time (see section 4);
- you break these terms or the Acceptable Use Policy;
- your service is a security risk to our network or other customers, for example if it is compromised or under attack;
- we suspect fraud, or a payment is disputed; or
- the law or a court order requires it.
Where we reasonably can, we’ll warn you first and give you a chance to fix the problem. We act without notice when the harm is serious or ongoing. Suspension is our first step where it is enough. We may also stop offering a service entirely with at least 30 days’ notice and a prorated refund of any prepaid, unused term.
What happens to your data
Your data is yours. When a service ends, you have 7 days to get a copy: download it yourself, or ask us and we’ll help. After that, it is deleted from our live systems, and copies in our backups are deleted as those backups expire, within about 30 days. Records we must keep by law, such as invoices, are kept as described in the Privacy Policy.
Sections that by their nature should last after termination continue to apply, including those on payment, content, liability, indemnity and disputes.
10. Support
Open a ticket in the Unified Panel. A person from our team in Nova Scotia answers. We also run a community on Discord, where other users may help; it is not an official support channel. Unless you buy a managed service, support covers our platform and the service we provide, not the software you install or your own code.
11. Emails from us
We send service emails about your account: billing, renewals, outages, maintenance and security. These aren’t marketing, and you’ll get them while you have an account.
We send marketing email, including our newsletter, only with your consent. Newsletter sign-up is confirmed by email (double opt-in). Every marketing email has an unsubscribe link, and we act on it promptly. You can also turn marketing off in the panel under Settings > Notifications > Marketing & announcements.
12. Third-party software and licences
Services can include or let you install third-party software, such as operating systems, control panels, game server software and mods. Its own licence terms apply, and you must follow them. You are responsible for licensing any software you bring, including Windows. We don’t control third-party software and aren’t responsible for its defects, updates or end of support. If a game publisher or software vendor changes its terms or stops a product, we may have to change or stop the related service.
13. Intellectual property
Ours: the Sable Servers name and logo, our websites, the Unified panel and our other software and materials belong to us or our licensors. While your account is in good standing, we give you a limited, non-exclusive, non-transferable right to use them to access the services. You may not copy, resell or reverse-engineer them except as the law allows. Reselling our services needs a written reseller agreement.
Yours: your content stays yours (see section 7). For quoted work such as websites or custom applications, the signed quote says who owns what is delivered.
If you send us feedback or suggestions, we may use them without owing you anything.
14. Confidentiality
We keep your non-public information confidential, including your content, configuration, credentials and business details. We use it only to provide the services and share it only with staff and service providers who need it, or when the law requires. You keep our non-public information confidential too, such as quote pricing and security details we share with you. This doesn’t cover information that is already public or that someone received lawfully from another source.
15. Warranties
We provide the services with reasonable care and skill. Apart from that and what these terms expressly say, the services are provided “as is” and “as available”. To the extent the law allows, we disclaim all other warranties and conditions, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the services will be uninterrupted, error-free or completely secure. If you are a consumer, you keep any warranties your local law gives you that can’t be excluded.
16. Limitation of liability
To the extent the law allows:
- Our total liability for all claims relating to a service is limited to the amount you paid us for that service in the 12 months before the claim arose.
- We are not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, business, goodwill or data.
- We are not liable for loss caused by your failure to keep backups, weak or shared passwords, your own software, or events covered by section 18.
These limits don’t apply to liability that can’t be limited by law, such as for fraud, gross negligence, wilful misconduct, or death or personal injury caused by negligence. If you are a consumer, they apply only as far as your local consumer protection law allows.
17. Indemnity
You will compensate us for claims, losses and reasonable legal costs that third parties bring against us because of your content, your breach of the Acceptable Use Policy, or your use of software you haven’t properly licensed. We’ll tell you promptly about any such claim and let you take part in the defence. This doesn’t apply to the extent the claim was caused by us. For consumers, it applies only as far as local law allows.
18. Force majeure
Neither of us is responsible for delays or failures caused by events beyond reasonable control, such as storms, floods, fire, power or upstream network failures, attacks on the wider internet, strikes, pandemics or government action. We’ll keep you informed and restore service as soon as we reasonably can. This doesn’t excuse you from paying for services you received. If an event stops a service for more than 30 days, either of us may cancel it, and we’ll refund the unused prepaid term.
19. Governing law and disputes
These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there. The courts of Nova Scotia decide any dispute.
If you are a consumer, you keep any rights and protections your local consumer protection law gives you, including the right to bring a claim in your local courts. This includes residents of Quebec and of the United States. Nothing in these terms takes those rights away.
If you have a problem, contact us first at hello@sableservers.com. Most issues get sorted out quickly, and we’ll try in good faith to resolve yours within 30 days before either of us goes to court.
20. Changes to these terms
We may update these terms. For material changes, we’ll give you at least 30 days’ notice by email and on this page before they take effect. If you don’t agree, you can cancel before then, and we’ll refund any prepaid, unused term. If you keep using the services after the changes take effect, the new terms apply. Minor fixes, such as typos or contact details, may take effect right away. The effective date is shown at the top of this page.
